Terms of Service

These terms are the agreement between you and Poxi AS, the company in Norway that builds Ember. Using the app means accepting them.

They are short because the app is simple: you write down what you mean to do, the app keeps score of it, and either side can walk away.

Your account

One account is one person. Keep the password to yourself, and treat what happens under the account as yours. Attach an email address if you want to be able to get the account back: without one it cannot be recovered and we cannot recover it for you.

What you can and cannot do with it

Use Ember for your own habits and tasks. Do not:

  • attack the app or the servers behind it, or try to reach another player’s record;
  • patch the client to forge score, coins, levels or streaks;
  • resell or rent access to it, or pass your account to somebody else;
  • use the ideas board to harass anyone or to post something illegal.

What you write stays yours

Your habits, tasks and notes are yours. You give us only the permission needed to store them, show them back to you and sync them between your devices, and nothing more.

The ideas board is the exception, because it is public: posting there gives us permission to show the post to other players and to act on it. Posts can stay on the board after an account is deleted, with the name removed.

Free, and membership

Ember is free to use, with a limit on how much of it you can do in a day. A membership lifts that limit. What the free tier includes and what a membership adds are shown in the app, and both can change as the app does; what you are buying is always on the screen before you buy it.

Memberships are sold by Apple and by Google, on whichever plans their store shows you, at the price it shows you. They renew automatically until you cancel, and you cancel in your App Store or Google Play account, at least 24 hours before the period ends. Cancelling stops the next renewal; it does not end the period you have already paid for.

A plan may begin with a free trial, its length shown on the screen before you press. When the trial ends it becomes a paid membership at the price shown, unless you cancel before then; cancel during the trial and you pay nothing. The store decides who is offered a trial, and it is normally offered once.

Refunds are the store’s to give, under their own rules, not ours. If a price changes, the store tells you before the change applies to a renewal.

The score is settled on our side

Streaks, payouts, levels and every other number the fire keeps are calculated on our server from the same rules the app draws with. Where a client says something different, the server is right. Rows written by a modified client can be corrected or removed.

The app is not advice

Ember is not a medical device and it gives no medical, psychological or financial advice. The breathing exercises, the meditation timer and the step counter are there to keep a habit going, not to treat anything. Step counts come from your phone’s sensors and are as accurate as those sensors are, which is to say roughly.

What we promise, and what we do not

We will keep the app running as well as a small team can. We do not promise it is always up, that a feature stays forever, or that nothing is ever lost. Features can change or be removed, and the app is provided as it is.

Keep your own copy of anything you could not stand to lose.

Ending it

You can delete your account from inside the app at any time, from Settings, and that ends this agreement. We can suspend or close an account that breaks these terms, and we will say why unless the law stops us.

If you got Ember from the App Store

Apple’s Licensed Application End User License Agreement also applies, and where it and these terms conflict, Apple’s wins. Apple is not a party to this agreement, has no obligation to support the app, and is a third party beneficiary entitled to enforce it. Any claim that the app fails to conform goes to Apple for a refund of the purchase price, and no further.

Liability

As far as the law allows, we are not liable for indirect or consequential loss, for lost data, or for anything you did or did not do because of what the app said. Nothing here takes away the rights you have as a consumer, which cannot be signed away.

Changes, law and where an argument goes

We can change these terms, and the date at the top changes with them; using the app afterwards means accepting the new version.

These terms are read under the law of Norway, and a dispute goes to the Norwegian courts, unless you are a consumer somewhere else, in which case the protections and the courts of the country you live in still apply.
